Eligibility Criteria

Eligibility Criteria of Spouse Open Work Permit for work permit holders

To be eligible for the Spouse Open Work Permit, you must meet the following criteria:


  • Spouse/Common-Law Partner Status: You must be the spouse or common-law partner of:
  • A skilled worker holding a valid work permit for a job listed in the National Occupational Classification (NOC) skill type 0, A, or B.


  • Valid Status: Your spouse or partner must have a valid study or work permit.


  • Proof of Relationship: You must provide documentation proving your genuine relationship with your spouse or partner.

Eligibility Criteria for Spouses or common-law partners of study permit holders

On April 30, 2024, the Minister identified the work performed by the following spouses or common-law partners of full-time students as essential according to subparagraph 205(c)(ii) of the Immigration and Refugee Protection Regulations (IRPR):


  • Spouses or common-law partners of full-time students enrolled in graduate programs (master’s and doctorate).


  • Spouses or common-law partners of full-time students participating in eligible pilot programs administered by a province or territory.


  • Spouses or common-law partners of full-time students in professional degree programs at a university (e.g., medicine, dentistry, law).


  • Spouses or common-law partners holding a valid open work permit under the C42 category and extending their work permit as spouses or common-law partners of full-time students in a post-graduation work permit (PGWP) eligible program of study at a PGWP-eligible designated learning institution.
